Based on your explanation of the potential three prior art situations, it seems to this layman that DM etc. has successfully differentiated our patents from them. Let's hope that the examiner sees it the same way. Anything can happen when your fate is in someone else's hands, but I keep coming back to DM's extensive and thorough due diligence and subsequent decision to take the case on a contingency basis as a significant positive.
