You're not misleading, that is exactly the case.....the examiner has not offered any uploads of any kind of what is on his mind.

Not for the 7-30 response by e.Digital, or the 8-24-12 supplemental response by e.Digial has the USPTO responded with PAIR filings.

"All there is are procedural entries I will call it, and the 8/30 appeal appears to be ditto."

IMO, the appeal is induced, someone is not satisfied.

Time will tell...because at this point, neither e.Digital, or the USPTO are giving results.
