I have confirmed with plankton, the Gazette updates every Tues.
Assuming the NIRC is in fact without anymore issues, the reaffirmation is a material event and an 8-K is due, PR is a given.
I am also sticking to the 8/30 "appeal" filing to be a prodcedural deadline on EDIG's part too, as stated previously, regardless of not receiving another rejection.
IMO, we knew what he'd accept, we submitted it, so this is nothing more that a formality.
Getting claim 5 to what the examiner can agree with is nothing compared to all the hullabalu on 774.
Handal sign us on before knowing 737 was wrapped up? Note: phone calls between EDIG and our patent law firm. the law firm and USPTO are not filed. I say all parties knew this was a go to be mailed on Sept 20. Also note EDIG's PR...all 5 listed.
