IMO, that is what they will do if the judge agrees with e.Digitals postponing the defendants motion.

IMO, JVC(as this is not an Apple issue, it's a JVC issue as they started it) can not come up with the language for a favorable ruling on a subsequent Markman hearing.

Thing is, with a postponement the questions of CE still stand for another day if settlements evolve....however, if JVC and the others settle as a result of the judge going along with e.Digitals proposal....future defendants might not even go there.
