I hate to even bring it up and certainly do not want it to happen, but this is a discussion board, right? The denial of collateral estoppel on all but 774 seem like a foregone conclusion to us--so why is the judge approaching double the time in which he said he would try to have a decision. Hopefully it is as Observer says above and Dish agrees. Could it be taking so long because the judge knows that he should not grant collateral estoppel for 774, but is trying to figure a way to do just that to side with Goliath? I sure hope not, but that is another side of the proberbial coin.
