This company just can't seem to get a break. Pointing out the issues of bad luck, I would say, is what this thread amounts to.
DM had to contend with the RE-exam issue in the middle of the case as well.
There was a lot to think about.
With that, IMVHO, the way the legal considerations come together through the Markman proceedings, the court is harder to reach than a jury might be.
This stuff is really not that complicated....yet through these proceedings they are coming off complicated.
The thing about a jury...it is more non bias....than an individual can be.
