Defendant’s Application To Compel Production of the Huawei

Settlement Agreement, as made in the Joint Statement of Discovery

Dispute dated December 4, 2013, is DENIED.

Counsel have failed to fully and meaningfully meet and confer

regarding all issues in dispute. See Local Rule 26.1 and Magistrate

Judge Gallo’s Chambers Rules, Rule IV.

Defendant has failed to make an adequate showing that the

contents of the Huawei Settlement Agreement are relevant to its Motion

To Amend The Partial Stipulated Judgment, and that its lack of

knowledge of the contents of the Settlement Agreement precludes its

arguments pertaining to it.
