That is why I stated the difference between my thoughts and the company's position and management responsibilities. The company may not want to go head strong with FlashR if the income is sufficient enough on settlements. Meaning they will not hold out for the absolute best dollar by forcing issues legally, if settlements are mutually met while at the same time they might be marketing the newer issues to the defendants.
The settlements are based on all the issues ....new claims construction of the various patents; the issues surrounding the CE appeal; future IP considerations.
I understand all that, my point is... that with all that.... the CE appeal could be so much of a power house in their corner at the negotiating table, the cases would never go the distance to claims construction. The writing would be on the wall, as they say, it would cut the case time in half.
