IMHO, 108 has a much better chance of being removed from the CE than 774. This would be very positive for the most recent 40 or so suits. If the whole thing is thrown out then if there is another Markman, the results of the re exam would be allowed in which clarifies things in our favor and negates the Colorado mess. That was in I think June or July of 2011. If I recall correctly, the mood on the board going in to that hearing was very upbeat and many were expecting to prevail--enter Judge Krieger and Duane Morris verbally attempting to show her up in open court followed by the unfavorable decision. Approaching 3 years since then and we still have no debt, have a few bucks in the bank, are trying to get back to where we thought we were with the flash patents but now we also have micro signet and nunchi as possible, not yet materialized, income streams. These are the facts from my perspective and they will remain so until they are no longer the facts and new ones arise.
