Not positive about this but at some point patents become "uncloaked" and are part of the public domain for all to see and read and study. Companies then have to decide whether to contact that company and negotiate a license or steal and take their chances of getting caught. So could they have stolen it verbatim, yes............I suppose it is also possible that they had something very similar and used it unknowlingly. That is why things go to court.
