Most important paragraphs from recent court of Appeals in regard to patent # 108
Most important, because they are the points Huawei , SNDK, GoPro, Pantech would have to get turned around..if they choose to petition for re-hearing.
To me this is a very firm consideration by 3 judges..
"While the ’108 patent may incorporate
by reference the ’774 patent as prior art, it does not
change the fact that the patents are not related."
You cannot argue with facts considered by three judges. These are done deals in legal respects...lets get on with it.
A re-petition is not happening by any of them.
