Good point Doni. If I am reading your post right, if we have to go through an IPR to legitimize our patent, why should the examples of prior art be accepted at face value and not have to have an IPR themselves to prove their validity as evidence? We had to argue for "plain and ordinary meaning"--why should the prior art examples be automatically accepted as written? The lawyers always win--an IPR for an IPR for an IPR--LOL.
