We should all hope that actually happens.

If they prevail at IPR, regarding prior art issues, an appeal, however that might take place at this level, would be hard to win. The IPR, which I view as nothing more than an extended prosecution of the patents, would be exhausted of prior art questions.

Patents hardened by USPTO through two separate venues of the USPTO would be so close rock solid...along with positive claims construction results through the civil system....collectively, might prove a tough hill to climb regarding appeals.

This whole AIA / IPR ...congressionally "deep pocket" lobbied and approved legislation, IMO, might turn out to be a BIG back fire.

They're now trying to revert issues of the AIA form some of the news I've read and heard. Perhaps they're having second thoughts because of the appeal issues. As it looks to me, if e.Digital has positive results, the opposition can't play the system like they use to.

7 months and all our questions are answered.
