The lawyers have charted a course, most surely within the law, and wholly defensible, with precedent.  There was no money, Edig could not survive as a going concern, and alternatives were few, bankruptcy imminent, and only after fighting for an eternity to stay afloat, the decision was made to file.  The patents are in some form of escrow, pending assignment to the attorneys as collatoral for unpaid fees.
