Are you stating you feel it wouldn't have mattered? I'm not saying 'this will get the ball rolling', but I do have the feeling that it could possibly have a downside trying to find another party willing to commit to invest.

I must add that I'm not an American, and have hard enough times coming to grips with the language, let alone the legal side of things that side of the pond.
