PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT AND IN THE ALTERNATIVE FOR PARTIAL SUMMARY JUDGMENT/TRIAL SETTING CONFERENCE No parties are present. AS TO PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT AND IN THE ALTERNATIVE FOR PARTIAL SUMMARY JUDGMENT: Counsel argue to the Court. For the reasons set forth on the record, The Court declines Plaintiff’s motion for partial summary judgment with respect to the counterclaims asserted by the Defendants, particularly breach of contract, unpaid compensation, conversion, breach of good faith and unfair dealing, and unjust enrichment and with respect to whether or not the obligation becomes due and owing. AS TO THE TRIAL SETTING CONFERENCE: The Court informs counsel of the current restrictions in place with respect to setting jury trials due to COVID-19 and encourages the parties to attempt to resolve as many of the issues as possible.
