For me, here's how it worked for the last years.

1) If you transfer shares at a loss, you won't be able to register the loss. To register a loss, you need to sell your shares and wait XX number of days before re-purchasing them in your TFSA account.

2) If you transfer shares with a profit, you need to pay taxes on the gain as usual.

3) When you transfer shares, you can transfer them anywhere between the low & high price of the day. Obviously, you will always want to select the lowest price possible.
