I do not see the benefit of that as they have no idea what is going to transpire in the next 3-5 years. If you believe they are waiting us out, that play is not helpful to VZ. If they do declare BK, that does not mean KRY is out of business. If I were a big player in the market, I would then buy the company as is for pennies on the dollar, keep the entity alive for the sake of the MOC and sue VZ's ass off. That my friend is a few million dollars for a few billion dollar payout. This issue with KRY is a SHAREHOLDER problem not a MOC/VZ problem. That MOC is enforceable for KRY no matter WHO owns it. I am sure Hugo has been made quite aware of the fact that a change of ownership does absolutely NOTHING as far as his legal problem is concerned. This will cost VZ dollars no matter what.
