Nobody would want a liquidation though, as that could threaten the viability of the arbitration.

Maybe I am naive, but if by KRY filing bankruptcy puts the ISCID case in jeopardy, that also means no money for the bond holders. It would appear the bond holders would also be taking a risk if they don't wait for the payout from the case.
