Tenor bothers with Crystallex for the juicy arbitration proceeds.
Outweighs whatever perceived liability and problems of the shell.
Remaining/Continuing as a shell business, and keeping arb proceeds as, "added value," compensation to management and board members would not be unusual for a dark Pinkie. No assets? No problem. A dark company, beholden to no one, need not show profit.
Expect ICSID hearing/collection delays to enable the Tenor Funding Extravaganza to receive additional arbitration proceeds. Last funding, before they went dark, was some fairly expensive bucks for Commons. Future funding will likely siphon more from Commons.
Seen a lot of shenanigans in pinks.
Just putting the possibility out there.
Hope to not be right about it.
But, just as possible as the "check" or "early settlement" theories.
