As far as I can remember, the idea that Minera Exar faced "criminal chares" was some combination of panic and mis-translation on TOB. From the limited Spanish I have (enough to barely get by in small villages in rural Mexico and Peru), combined with the help of Google, the governor only ever called for an investigation. I've never seen anything about criminal charges. Would make sense: the investigation comes before the charge, even in AR. 

Otherwise, we just don't know. It could be the fines, it could be bribe money, or something in between...
