Mediation concluded on September 27. That is when the Court(Judge)ordered it to be concluded. Mediation could NOT go on past that date unless an extension was applied for and granted by the Court. As there are no filings to that effect, that is the only outcome.

For there to be a continuance(legal, not lay, definition), ALL parties to the case had to agree, and a mediation report stating such had to be filed with the Court. No matter what the outcome, at the conclusion of the mediation(see above)the mediator was to file a mediation report within 5 days of September 27.

Reasons are never given for a continuation in the mediator's report, but confirmation from the Court as to permissable evidence has been sought as a matter of urgency. Based on precedent and statute, it is unlikely that Higgins et al will be allowed - that doesn't mean to say it won't though. It is possible that either side might Appeal the judgment but more probable, in that event, the verdict will go for the Plaintiffs.
