The PR for the APC License is dated 10/3. The only other PR's issued since the end of August are for Denso & DMP Electronics. Unfortunately, based on today's PR which states that THREE licenses were signed in Sept. it appears as though the APC license was included in Sept, but not annoucned until Oct 3. Not a huge issues, but means that the $1.433M colleceted in license fees since the end of the quarter is split between 3 licenses rather than 2. Therefore, the average value of the last 5 licenses is $2.953/5 or only $591K each.
Again, I know that licenses are based on the companies level and volume of infringing products, but it certainly seems as though TPL/PTSC has begun to settle for license fees that are a pittance compared to the signings from last year. The "early mover discount" has actually turned out to be an early mover premium. These license values are starting to appear as though they've begun to agree to "nuisance fees" rather than legitimate license fees. I know the big issue will be the J3 settlement or trial outcome, but in the meantime, settling for pennies in my opinion is counter productive. Better to wait 6 months to sign these last 5 licenses and get more money for the license (even if it were an avg of only $1.2M that would be a 100% appreciation for waiting 6 mos) than it is to set a precedent of paltry license fees.
Again, I concede that I don't know the level of infringing product involved here, so this is a bit of conjecture, but anytime you include "electronics" companies and "IT" companies and "industrial robot manufacturer" companies, I'd expect there to be a decent amount of microprocessor technology being used, and thus would expect more than $591K per license.
While I want to see licenses signed, I do think they need to be careful in balancing getting deals done to support the J3 case vs. giving away millions in fees just to do so.
