The J-3 may actually want to settle "before" the USPTO review. If it goes against them, it's a huge nail in their coffin and weakens their bargaining position. It cuts both ways - and since so many other companys believe our patents are valid, the J-3 carry greater risk (than us) on waiting for a USPTO review.
