If Rare's father-in-law were correct then no publicly traded company could ever enter into a NDA, so its not quite that simple.
My questions are:
When does NDA expire?- will we ever be informed of the settlement details?
Are all or any future settlement terms going to have a NDA?
TPL has exclusive licensing authority but they have a fiduciary requirement and I would assume an express contractual requirement to act in a way that does not harm PTSC. NDA has no effect on TPL and as we are seeing it has a devastating impact on PTSC. Why is our BOD okay with this? More NDAs will be fatal to our company. IMO PTSC should be taking legal action against TPL to stop any futher NDAs. Because of the impact the NDA has had, unless Patriot signed off on it, TPL's agreement to have a NDA I believe would violate the terms of their contract to act in a way that does not harm us and perhaps TPL could be removed from having exclusive licensing authority. This is where I see the real legal battle and I would very much like to have our BOD or Brian comment on it.
