But your answer ignores that there are three possible outcomes from the PTO. If the PTO result is a complete thumbs-up for us - things could happen per the agreement. If the PTO result is a total thumbs-down for us - things could happen per the agreement. But what about anything in between? What if certain claims in one or both patents survive, and others don't? What if claims are modified or added, and approved? Not so clear-cut, then, is it? Maybe this helps you see where I'm coming from....particularly with regard to the jurisdiction issue.
