If it is decided...by the lawyers... that the description for the processing unit can be "clarified" to the acceptance of the examiner...AND...more importantly that this modification does NOT lessen our "bite" in the claims it effects...then IMO an answer by us, agreeing with the examiner, would be quickly followed by an intent to reissue certification.

Remember the Choate report that showed a vast majority of ex parte reexams do come back with some claims changed or all denied (71% for third paqrty requestors))...what that report doesn't tell you is how many of those changes cost the patent holder licensing deals due to those changes.

That part of the report goes undetermined by the PTO...it just shows how many of the ex parte reexams kept a patnet from being reversed and denied...the stats to watch are the ones that were requested by a third party...those are the ones that our reexams fall under...
