a. Reexam # 90/008,225 and Reexam # 90/008,2992 A Reexamination Certificate issued on July 21, 2009, with amended Claim 29. Defendants have not asserted infringement of the ‘584 patent in a counterclaim. >
The 584 seemed to be an intregal part of infringement. It was asserted against ACER, HTC, Sirius and Barco.
Pulling the 584 assertion against ACER has me puzzled. I'm wondering if we will pull it from any of the other cases as well. And of course wondering why pull it. It would seem to me that even if amended claim 29 made it more difficult to prosecute in court, I'd leave it alone for now rather than to signal that perhaps it has no teeth anymore. Is there anything to gain by pulling it now?
Is it possible that ACER uses chips that contain ARM technology? Might there be a change in strategy relative to the 584? Might we assert the 584 against ARM as opposed to individual users of the tech?
Something to keep our eyes on.
