Could it be possible that after the announce of the USPTO intent to recertify the 336 that the three companies who signed did so immediately. Others were possibly in negotiations or willing to start negotiations when the USPTO accepted to review the new challenge of the 336 and issued it to a new examiner. Are we not waiting near three months to see if the USPTO accepts this review???? Would this not put all companies in negotiations in limbo again???? Or do we truly feel negotiations are still ongoing and recertification / gazzette anouncement in "was it November or December is eminent?
