Actually, as was correctly pointed out to me after one of my last posts, while the '336 has in deed been recertified, it is still in fact under Reexam consideration once again with diff prior art cited.. and will be considered 'under Reexam' until the PTO files a dismisal of that reexam request (hopefully soon but could be another 2 months).. so this does possibly give 're-engaged' negotiating companies reason for pause yet again..
