The examiner had up to 3 months from 08/24/09 to determine if the reex was to be ordered or not. There is no time limit to complete a reexamination. The length of time would depend on the Office Actions and our responses that follow.

Now that the reex has been ordered, we have the option to file a statement or wait for the next Office Action which may merit a response from us if it isn't a NIRC.
