IMO, unless TPL is precluded from being the "solely" negotiating arm of the MMP, TPL has significant leverage. PTSC must prevent in some way or fashion TPL from holding PTSC hostage in negotiating licenses separately. Operationally, PTSC may designate TPL responsible for negotiating licenses for efficiency sake, but should never give up the right presently or in the future. It creates a level playing field and prevents Leckrone from entertaining anymore crazy ideas in the future in this regard.
Furthermore, the prior agreement between PTSC & TPL, preventing PTSC from negotiating licenses with anybody for one full year must be declared null and void. IMO, you can bet, TPL has mountains of letters, real or fabricated, demonstrating evidence TPL contacted hundreds or thousands of companies (and all of the IBM, Apple, TI, BMW, GE, etc) of the world, to prevent PTSC from negotiating licenses in the future, if the MA is torn up and PTSC & TPL are allowed to negotiate independently.. A race to the bottom with PTSC resigned to negotiating crumbs for sure if this were to happen.
