I'm sure Ron or another will correct you, or me, or both of us if we are wrong.
You are absolutely wrong in your thinking that the Markman results having anything to do with the Barco litigation concerning the IC's.
The Markman is simply (ha!) trying to come up with a judge-declared set of terminology that both parties must abide by in case they decide to go further to a court trial.
The Barco litigation is about trying to get out of any litigation at all --- they wanted a summary judgement of non-infringement based on the IC's that TPL had put in front of the court on some of their products. The Special Master has ruled that we have 20 days to respond with more specific IC information.
So Markman result DOES NOT depend on the Barco issue.
More nervous chatter clouding up the airwaves.
