Message: Re: The Moore Settlement with TPL .. Admiral Bird Banos

Of course, I don't know for sure, but I'm confident that his license is like every other license we have granted. It includes permission to incorporate the MMP into his work product; NOT to be a Licensor of the MMP who could compete with us against infringers.

I will however say that, it's plausable, and I think maybe likely, to speculate that Moore's license will carry the ability to protect downstream users from additional MMP licensing and Royalties for applications of his Green Arrays MMP inclusive products.

I speculate that because:

1. the JV partners needed this settlement done long ago; they are running out of time and Moore may have had a solid enough case which might have lead to breaking up the JV.

2. there are only 2 years left on the longest patent Expiration date

3. the company supposedly (post to this Board quoting the company) will not be filing for patent life extension to the MMP Suite

4. Moore's chips do not yet appear to be on the immediate verge of wide scale high quantity acceptance and usage.

5. PDS (TPL and PTSC) likely concluded that any lost future Royalties from Moore's reen Arrays downstream users will not be significant enough to offset the benefits of granting this type of inclusive license to settle the case. Besides, pehaps they finally feel Moore is owed some special consideration for giving birth to the MMP, and their individual benefiting from what are most likely very swollen personal bank accounts.

That's my speculation, but I don't know.
