No, they have the option to extend it if they want. They will have an idea at that point how many people have tendered and whether it makes sense to extend it or whether they need to sweeten it at all or simply walk away.

One strategic move by the FWR BOD by signing that confidentiality agreement is that that agreement expires on Dec 1 so it buys them some time and creates some uncertainty for another two week period after the NOT offer is set to expire. If nothing else their buying some time to try and save themselves whether that other agreement is legit or NOT.
