"Prior right on a mining claim for me?
I suspect it means that if KWG wants to build a mine, or even a workers shack, on a particular spot of it's claim they get priority to use it before anyone else who has no claim of any kind but just would like one.
Cliffs in this case has no rights but is hoping to get surface rights to a strip for that rail line.
Unfortunately for them KWG wants to impede as long as they are not compensated. By that I mean KWG wants to say that they intend to use the surface on the very strip of land needed by Cliffs.
( I am of the opinion that KWG will need to say what portion of the surface they need and Cliffs will have no choice but avoid it or pay to KWG to loosen KWG's surface needs. Cliffs is probably arguing that KWG has no right to the total surface above it's claims and that Cliffs should be granted it's strip. I also suspect Cliffs is arguing that point before the Ontario government's land use departmets and Courts as a last resort.
