Am I missing something or another misrepresentation?

All they talk about is a Road.

Did Cliffs apply for the easement ONLY for a road OR did they for a railway with a possible service road? I believe it must have been the latter. I also think that Cliffs would be satisfied if the easement was only for a railway.

Yup, "Someone should work on their PR-writing skills." and tell them to not misrepresent by turning things arround.
