"There's no doubt that in the situation where treaties are involved, the courts have generally taken the view that the lands are more easily opened for development," Janes said.
"There's no doubt that that will help the province advance a resource agenda. But what we've seen in Alberta and northeastern B.C. is that even in those lands, the courts have not said that it's a free-for-all."
This isn't about land title, but resources that are under Provincial jurisdiction. Seems the main issue is health and safety and conditions around forest practices. Don't see the provincial court ruling being overturned. Perhaps the outcome will receommend improvements to forestry practices and FN engagement. That being said, I've been surprised quite a bit lately by different court rulings and government decisions/actions so I guess we'll see what happens with this......
