A litigator friend of mine tells me that better than 90 percent of these cases never make it to court for settlement. In the meantime each and every legal manouver will be used to "outlast" or "gain the upper hand" as negotiation continue in the background.
As to a resolution, it takes a willingness on both sides to reach one. I guess we just aren't there yet.
