They were after an exclusive RBE (encryption scheme)....and for the most part that is what the judge ruled on. RBE is the outer encryption wrapper and has nothing to do with DRM, even though the agreement has the heading "DRM Agreement". DRM encoding is the bit stream that encryption is wrapped around during handling.

They're not getting an exclusive on the bit stream...
