How the newest prospective is placed next to the 2002 Boyer NDA and agreement, I have no idea.

e.Digital tried to out pace Boyer with "supercede" replacing the 7 year time frame.

digEcore tried to out pace e.Digital with yet another contract having unlimited exclusivity and non compete.

LL/Minister, if you where the judge in this matter how would you sort the above out?

Each condition has a face value...one ruled under the law....the other under the language of the agreement.

Does ruling under the law have more weight, than ruling from the agreement language?

I ask that, because digEcor was out flanked by e.Digital with the courts ruling on the more recent DRM agreement. My thought is, if digEcore opened up the channel with it's NDA contract and exclusive rights under it....would that not some how jeperdise their 2002 NDA?
