In any even, I have been thinking about the video vs audio situation and why a Markman ruling may have to happen to get full rights to video seeing that our patents are for audio....for the initial patents....IMO the 445 considerations are a different animal that would be the reason to reach a Markman.
Video alone(as most relate) is a combination of audio and video. My thought is, could we have an argument in busting up a video process ?
IMO, there could be a wedge driven between the two and the scope of audio alone broadens for the initial patents.
IMO, a Markman would give us full benefits....but for now we drive the wedge.
