Agreed. And if I may... To help us understand DM’s possible strategies, we might ask ourselves certain questions like:

1. How would a company likely react to an infringement suit given our current state of affairs? We have 6 settlements completed and are currently engaged with Samsung - which apparently will not be reaching a similarly simple conclusion. Would a new company likely choose to settle within 6 months or simply wait until Samsung either settles or goes through Markman (which is less than 11 months away)?

2. Would DM like to spend additional effort filing against new companies at this time... or should they be focused on winning a Markman (and trial if need be) against Samsung? We can talk about filling a pipeline or we can figure that taking down a large adversary should cause other companies to more easily fall in line.

I’m not necessarily saying that DM won’t file until after a successful Markman ruling, but they may want to travel the road with Samsung a bit longer so that future infringers can see for themselves the level of progress and commitment that DM has made.

And on an unrelated topic about things that are unrelated, there’s far too much discussion for it’s own sake around here... too much blabbering and too few genuine posts regarding EDIG. I’ve seen that frequency of posting is the sure path to higher point values and ranks - which is how someone such as DISCHINO made President (1500 points) before I did. Not that I care, but why should anyone? I welcome intelligent discussion but don’t believe that more posts are the answer. There are plenty of chatrooms out there if all you want to do is socialize. My two cents. Carry on as I know you all will.

Oh and one more thing since I just remembered this. I would never assume that sending a private message through a public chatroom to a person I didn’t know meant that the message would necessarily be considered or remain private. Trust is and should be pretty hard to earn on the Internet. But maybe that’s just me.
