If DM and Edig go once more through the NDA's and leave us and the market in the dark, I have great misgivings as to how the pps will respond. I hope that the settlements become public knowlege so that some PR can generate public interest.
Since so many here like to be realistic, then let me try to be realistic....
I would like to see EDIG promote themselves as much as anyone, but I don’t think they will in quite the way that we’d like... not given current policies and practice as I see it. Consider two big possible elements: a favorable Markman decision and a large eVU order by a major airline. Either one would be a significant announcement in itself. But is management really likely to go beyond making the initial announcement? Or does anyone really expect them to announce "numbers" if the airline doesn’t want that included or if any settlement terms are to remain undisclosed? I think microcap funds may take notice WHEN and IF there is something for them TO notice... which may be all that RP means when he makes that statement. There could well BE some promotion going on behind the scenes... a phone call here, a conversation there; but nothing that we’re going to be privy to. We won’t know much beyond what they announce just as is the situation today. Those looking for EDIG to change their MO and start blowing their own horn are probably going to be disappointed, IMO.
If they make a big airline order announcement yet this quarter, we’ll see the revenue from that in the 11/15/10 10Q. If there are no settlements before the Markman decision, then in the best case we will not see any IP revenue until the 2/15/11 10Q.
Does that mean the share price can’t go up until 2/15/11? Of course not. I guarantee you that if the Markman decision is favorable in October, all 16 defendants settle in November, and then another round is filed in December... the writing will be on the wall. It probably won’t work out this way, but there are dozens of possible permutations that can lift the share price before the end of the year. All we can do is watch with interest and see what happens. To say that things HAVE to happen in a certain way doesn’t take the many possibilities and variations into account, although I DO believe that a positive Markman ruling is a big key to our success.... and why I choose to focus on it.
Despite our current slump which seems as if it will last forever, the PPS will ultimately take care of itself given a sufficiently positive set of circumstances. The best thing is that we are moving forward and will finally get an outcome (whatever it may be) by (I believe) the end of the year. Another week or so and we should know the hearing date. Then we’ll be able to adjust our expectations and speculate a little bit more.
