That would be a good question to ask RP...
For my interpretations of all things considered.....and the request of a 2 phase discovery process suggested by the plaintiffs....
It would fit the flow of the request.
If it doesn't happen, all discovery is to be completed by the Markman date anyway.
Thing about that, would it give council for the plaintiff enough time to analyze the data and implement what they had in mind had they gotten the limited desired information earlier?
If it doesn't happen ...we are headed for the hearing and a judges consideration.
