Not only they are "abiding to requests", but they are fast at work trying to work out a settlement agreements that can be presented to the Judge for approval...

If you go back to the "Setting Orders" issued by Judge Krieger in July it contained a status conference date, usually is set 30 days before the "Trail Date" where parties clear the decks of all issues and streamline the the events that are to take place on "Trial Date", here the Markman Hearing date...

The fact that this Conference was a "Joint Request" by DM and the defense Counsel, and it was set ahead of the 30 days before "Hearing date", denotes that parties have been working together and have something they want to tell the Court which is significant enough warranting a conference with the Court...
