Judge Krieger ruled on only the analog part and construed it more narrowly than EDIG had proposed. The market did not like it and sold off and many of us started viewing the ruling as a loss. From what I have been reading from you and after reading the summary judgment article, leaving 737 in play was a HUGE plus for us--our company is, afterall called E DIGITAL!
The judge, in her explanation of her ruling, said something along the lines of "neither side got what they wanted, but I can see how it could be viewed as bad for Edig." The narrowed part is still in and is a part--when combined with 737 gets us where we want to be--the judge, the defendants, DM and we all know this. We were hoping for a resounding approval from the judge but instead got a backhanded compliment--a compliment none the less. Thus DM's response to her ruling(asking for a ruling on 737) is taking us down the path that we need to be on. Still a long way to go, but I feel that we are better off than we realize.
