I believe that the "applied prior art" comment has to do with the article that Techwhiz has referred to and wondering where the patent office investigator came up with it and was he tipped off by one of the defendants. That article was used by the patent investigator as a reason for a preliminary denial of the patent's validity which everyone has so far has said is merely a first step in the process to prove the patents are valid--far from a final decision.
