I have been party to many lawsuits over the past few years, and the lawyers always make motions for summary judgement, and the judge, at least in every one my cases, has denied them. I liken to the doctor ordering the cat scan on the remote chancet that something will show up, in order to cover his butt in case something goes wrong later - eliminates professional negligence liability issues.
