Defendant Intel Corporation (“Intel”) hereby provides notice to the Court
that, on August 29, 2014, Intel filed two petitions with the United States Patent &
Trademark Office (“USPTO”) requesting
inter partes review of U.S. Patent No.
5,839,108 (“the ’108 Patent”), which has been asserted by e.Digital Corporation
(“e.Digital”) against Intel in this case. (
See Exhibits A & B.) Intel challenged the
validity of Claim 1 of the ’108 Patent, which is the only claim that e.Digital has
asserted against Intel in this case.
